Applicable requirements: Essential entity or important entity (NIS2)
For context CTX-NIS2, this page brings together the Manual's base selection per level and each floor that the regime elevates, with the obligation that grounds it. A context never lowers a minimum of the Manual.
When it applies
The entity is essential or important under Article 3 of Directive (EU) 2022/2555, as transposed (in Portugal, the national cybersecurity legal framework). The context is declared per entity and inherited by all applications. Declared per entity and inherited by all applications.
Directive (EU) 2022/2555, Article 3(1) and (2): “For the purposes of this Directive, the following entities shall be considered to be essential entities”
Grades
- PERTINENTE — Relevant entity under Implementing Regulation (EU) 2024/2690 (cumulative with the context). The entity is of one of the types listed in Article 1 of Implementing Regulation (EU) 2024/2690 (DNS service providers, TLD name registries, cloud computing, data centres, content delivery networks, managed and managed security services, online marketplaces, search engines, social networks, trust services).

Requirements added by the regime
These requirements only make sense under the regime, so they do not live in the Manual's catalogues; they are defined here, each with its legal basis.
| Requirement | Name | Acceptance criterion | Legal basis |
|---|---|---|---|
CTX-NIS2-R01 | At least partial redundancy | Based on the risk assessment and the continuity plan, sufficient availability of resources through at least partial redundancy of the network and information systems and of the communication channels the application depends on; resources monitored and adjusted according to the backup and redundancy requirements. | Implementing Regulation (EU) 2024/2690, Annex, points 4.2.4 and 4.2.5: “shall ensure sufficient availability of resources by at least partial redundancy of the following” (NIS2-IR2690-4.2.4, NIS2-IR2690-4.2.5) |
CTX-NIS2-R02 | Significant incident criterion | An incident is assessed as significant, from the impact data in the record (Policy 32 §4.3), when it has caused or is capable of causing severe operational disruption of the services or financial loss to the entity, or considerable material or non-material damage to other persons; the assessment and the decision are recorded. | Directive (EU) 2022/2555, Article 23(3): “An incident shall be considered to be significant if” (NIS2-23-3) |
CTX-NIS2-R03 | Significant incident thresholds and aggregation of recurring incidents | For relevant entities, the criteria of Article 3 of Implementing Regulation (EU) 2024/2690 apply (direct financial losses above EUR 500 000 or 5 % of turnover, whichever is lower; exfiltration of trade secrets; death or considerable damage to health; malicious access capable of causing severe disruption; and the criteria specific to each entity type). Every quarter, the existence of recurring incidents is assessed: those that occurred at least twice within six months, with the same apparent root cause, and that collectively meet the financial criterion count as one significant incident. | Implementing Regulation (EU) 2024/2690, Articles 3 and 4 and Annex, point 3.4.2: “have occurred at least twice within six months” (NIS2-IR2690-art3, NIS2-IR2690-art4, NIS2-IR2690-3.4.2) |
How to read the list
Key: ✔ base selection for the level; ▲ elevated or added by the regime (applies by the regime; if the component does not exist, a documented justification of non-applicability is required); — not selected.
Activation rule. Effective requirements = technical selection ∪ elevated ∪ added. Ids with origin “base” enter only if the technical selection (the application's technical context) activates them. An elevated or added id without technical activation is not dropped silently: it enters flagged “applies by the regime; if the component does not exist, a documented justification of non-applicability is required” (model of Implementing Regulation (EU) 2024/2690, Article 2).

Obligations of the regime by coverage strength
Count of the regime's obligations in the coverage matrix (excluding those addressed to the authorities). The section “What this Manual covers and what stays out” lists them.
| Strength | Obligations |
|---|---|
| Covers | 98 |
| Partial | 57 |
| Supports evidence | 12 |
| Gap | 10 |
| Out of scope | 43 |
What this Manual covers and what stays out
All the obligations of the regime, in the Manual's coverage matrix, in three categories: what the Manual covers, and in what form; the declared gaps (what it does not cover by omission); and what is out of scope, with the reason. No obligation is left in silence. The 8 obligations addressed to the authorities create no duty for the organisation and are not listed.
Covers (110)
Strength “covers” or “supports evidence”. The form is the Manual's response: catalogue requirement, policy, section, floor or requirement added by the regime.

Declared gap (67)
Strength “partial” or “gap”: the Manual does not cover, or covers only in part, and says what is missing. Gaps pending an AppSec Core round are marked with the name of the round.
| Obligation | Reference | Strength | How the Manual responds | What is missing |
|---|---|---|---|---|
| NIS2-20-1 | Article 20(1) | Partial | GOV-001; Ch. 14 US-22; GOV-011; Policy 35 §5 | The Manual requires approval “by senior management” of the governance model and the policies, and reporting of KPIs to management, but does not assign to the management body the approval of the Article 21 measures as a whole, oversight of their implementation, or personal liability; the cross-check acknowledges that it “does not fix ex ante the exact legal form of the approval chain”. |
| NIS2-20-2 | Article 20(2) | Partial | Policy 37 §4.1; TRN-001 | There is no mandatory training of members of the management body in cybersecurity risk management: Policy 37 covers “staff with technical functions” and for “Management / Tech Lead” provides only “Executive awareness” at L1; regular training of the remaining (non-technical) employees is not prescribed. |
| NIS2-21-1 | Article 21(1) | Partial | CLA-003; Policy 02 §3; REQ-001 | The Manual's proportionality is per application (L1–L3) and covers the software lifecycle; it does not cover the entity's network and information systems as a whole (corporate network, workstations, premises, continuity). |
| NIS2-21-2 | Article 21(2), introductory wording | Partial | CLA-003; Policy 09 §3; OPS-016; OPS-017 | All-hazards approach: the application backups and recovery are covered (OPS-016, OPS-017); the physical environment and the entity's business continuity are out of scope; general cyber hygiene is partial. |
| NIS2-21-2-c | Article 21(2), point (c) | Partial | OPS-016; OPS-017 | The entity's business continuity and crisis management fall outside the scope of the Manual; recovery of the application is prescribed (OPS-016, OPS-017). |
| NIS2-21-2-g | Article 21(2), point (g) | Partial | Policy 37 §2; TRN-002; TRN-007 | Security training prescribed for technical roles and third parties with access; cyber hygiene practices and awareness for all (non-technical) staff and for the management bodies are missing. |
| NIS2-21-2-i | Article 21(2), point (i) | Partial | ACC-001; ACC-002; CLA-008; TRN-002 | Access control covered; asset management limited to the inventory of applications and components (no inventory of all assets nor asset handling policy); human resources security out of scope except onboarding/offboarding. |
| NIS2-21-2-j | Article 21(2), point (j) | Partial | AUT-001; AUT-008; 🛡️ Security requirements per environment; GOV-016 | Secured voice, video and text communications and secured emergency communication systems are not addressed (entity security, outside the scope of the Manual); MFA is prescribed for the application (AUT-001) and for privileged access to the supporting systems (GOV-016). |
| NIS2-21-3 | Article 21(3) | Partial | Policy 33 §3.1; Policy 33 §3.1; DEP-006; GOV-007 | Due diligence assesses the supplier's vulnerability management process and test reports (L2/L3), but not the overall quality of products nor secure development procedures as an explicit criterion, and ignores the Union-level coordinated risk assessments (Article 22). |
| NIS2-23-1-2 | Article 23(1), first subparagraph (second sentence) | Partial | Policy 32 §7 | There is a generic communication “to affected users where applicable”, but the NIS2 line of Policy 32 §6 does not include notification of the recipients of the services (unlike the DORA and CRA lines), with no deadline and no “likely to adversely affect the provision” criterion. |
| NIS2-23-2 | Article 23(2) | Gap | — | There is no duty to communicate to the recipients of the service significant cyber threats or the measures they can take; Policy 32 deals only with incidents. |
| NIS2-23-7 | Article 23(7) | Partial | Policy 32 §9; Policy 32 §7 | There is control over who authorises public communications, but not the procedure for informing the public when the CSIRT/authority requires it. |
| NIS2-24-1 | Article 24(1) | Gap | — | The procurement and due diligence criteria (Policy 33 §3.1) do not provide for the requirement of ICT products, services or processes certified under European cybersecurity certification schemes (CSA) where the Member State imposes it. |
| NIS2-IR2690-art2 | Implementing Regulation (EU) 2024/2690, Article 2 | Partial | GOV-004; Policy 05 §3; CLA-003 | Non-application of controls goes through a documented formal exception, but exemptions by level (requirements marked “-” or “Recommended” at L1/L2) are not exceptions and do not generate the documented justification, requirement by requirement, that Article 2(2) requires when a modulated requirement is considered not applicable. |
| NIS2-IR2690-1.1.1 | Implementing Regulation (EU) 2024/2690, Annex, point 1.1.1 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | GOV-001; Ch. 14 US-22; GOV-012 | There is no policy on the security of network and information systems with the minimum content of point 1.1.1 (approach, objectives, commitment of resources, documentation to be kept, list of topic-specific policies, maturity indicators); there is a governance model and a body of policies approved by management, with maturity only at L3 (GOV-012). |
| NIS2-IR2690-1.1.2 | Implementing Regulation (EU) 2024/2690, Annex, point 1.1.2 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Policy 32 §4.6; GOV-001; Ch. 14 US-22 | Yearly review and review after a significant incident prescribed; review after significant changes to operations or risks and documentation of the result by management are missing. |
| NIS2-IR2690-1.2.3 | Implementing Regulation (EU) 2024/2690, Annex, point 1.2.3 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Gap | — | The Manual refers to the CISO as a decision authority, but does not require designating a person who reports directly to the management bodies on matters of the security of network and information systems. |
| NIS2-IR2690-1.2.5 | Implementing Regulation (EU) 2024/2690, Annex, point 1.2.5 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | CIC-008; Policy 22 §5 | Technical segregation of duties in pipelines and IaC apply (L2/L3); there is no organisational rule for segregating conflicting areas of responsibility. |
| NIS2-IR2690-2.1.1 | Implementing Regulation (EU) 2024/2690, Annex, point 2.1.1 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | CLA-001; CLA-007; Policy 03 §7 | Per-application risk framework with documented residual risk; acceptance of residual risk goes up at most to the CISO — not to the management bodies — and there is no risk treatment plan for the entity. |
| NIS2-IR2690-2.1.2 | Implementing Regulation (EU) 2024/2690, Annex, point 2.1.2 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Policy 02 §3; THR-001; THR-004; Policy 03 §5 | Methodology (E/D/I axes, STRIDE) and threat disposition exist, but the process is per application: entity risk tolerance, identification of third-party risks and single points of failure, and threat modelling at L1 are missing. |
| NIS2-IR2690-2.1.3 | Implementing Regulation (EU) 2024/2690, Annex, point 2.1.3 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Policy 19 §4.3; KEV — confirmed exploitation; CLA-003 | Prioritisation by severity, exploitation (KEV/EPSS) and level; no cost-benefit and no link to business impact analysis. |
| NIS2-IR2690-2.3.1 | Implementing Regulation (EU) 2024/2690, Annex, point 2.3.1 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Ch. 12 US-12; Ch. 14 US-22; THR-007 | Internal and adherence audits provided for; an independent review of the approach to security management as a whole (people, processes, technologies) is not required. |
| NIS2-IR2690-2.3.2 | Implementing Regulation (EU) 2024/2690, Annex, point 2.3.2 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Gap | — | There is no requirement for audit competences or for hierarchical independence of reviewers from the area reviewed (independence appears only in the threat model — THR-007 — and in testing). |
| NIS2-IR2690-2.3.3 | Implementing Regulation (EU) 2024/2690, Annex, point 2.3.3 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Ch. 14 US-22; GOV-010 | Deviations generate corrective action; communicating the results to the management bodies, or the formal alternative of acceptance of residual risk by them, is not required. |
| NIS2-IR2690-2.3.4 | Implementing Regulation (EU) 2024/2690, Annex, point 2.3.4 (Article 21(2), point (a), of Directive (EU) 2022/2555) | Partial | Policy 32 §4.6; Ch. 12 US-12 | Yearly internal audit and review after a significant incident; no trigger after significant changes. |
